These Terms and Conditions ("Terms") govern your use of the Hiaibox mobile application (hiaibox), owned and operated by Hiaibox LLC ("we," "us," "our"). By accessing or using the App, you agree to these Terms. If you do not agree, you should not use the App.
1. Acceptance of Terms
By registering for or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Use of the App
The Hiaibox App allows users (primarily truckers) to upload information about truck issues and receive feedback, advice, or solutions from the community, which includes other truckers and mechanics.
You agree to:
- Use the App in compliance with applicable laws and regulations.
- Provide accurate and truthful information when creating an account.
- Be responsible for the security of your account credentials and all activities under your account.
- Not misuse or abuse the App by posting inappropriate, harmful, or illegal content.
3. User Accounts
To access the App, you must create an account and provide accurate information, including a valid email address. You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You agree to notify us immediately if you suspect unauthorized access or use of your account.
We reserve the right to terminate or suspend your account if we believe you are violating these Terms or engaging in unauthorized activities.
4. User-Generated Content
When you upload truck issues, photos, videos, or any other content to the App ("User Content"), you grant Hiaibox LLC a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the User Content as necessary to operate the App.
You represent and warrant that:
- You own or have the necessary rights to upload the User Content.
- The User Content does not violate any third-party rights or applicable laws.
- The User Content is accurate and not misleading.
We reserve the right to remove any User Content that violates these Terms or is otherwise inappropriate.
5. Prohibited Conduct
You agree not to:
- Upload or post any content that is illegal, harmful, threatening, defamatory, obscene, or otherwise objectionable.
- Use the App for any fraudulent or unlawful purposes.
- Interfere with the operation or security of the App or others’ use of the App.
- Post spam, advertisements, or unauthorized promotions.
- Collect personal information from other users without their consent.
Violation of these terms may result in the suspension or termination of your account.
6. Payments and Fees
The Hiaibox App is free to download and use, but some features or services may involve fees. We will inform you of any charges before you incur them. You are responsible for paying all applicable fees and taxes associated with your use of paid features or services.
7. Limitation of Liability
To the fullest extent permitted by law, Hiaibox LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App or any User Content.
We do not guarantee that the advice or solutions provided by users in the community are accurate or will resolve your truck issues.
8. Disclaimers
The App and its content are provided "as is" without any warranties, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the App will be available at all times or free from errors or interruptions. You are solely responsible for your use of the App and any risks associated with using information or advice from the community.
9. Termination
We may suspend or terminate your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease, and we may delete any User Content associated with your account.
10. Changes to the Terms
We reserve the right to modify these Terms at any time. If we make significant changes, we will notify you by posting an updated version of the Terms on the App or through email. Your continued use of the App after such modifications indicates your acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Ohio, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Ohio for any disputes arising from or relating to the App or these Terms.
